By purchasing / requesting services or products from Auto FX, you understand and agree to all of the following:
General
Typographical Errors
- In the event of an incorrect price listed on our website or e-mail due to typographical error, Auto FX shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.
- Auto FX shall have the right to refuse or cancel any such orders whether or not the order has been confirmed.
Images
- Some of the images shown on this site may not be the image for your specific vehicle. They are used for reference purposes only. PERFORMANCE PARTS CANNOT BE RETURNED BECAUSE OF IMAGE NOT MATCHING. Images of items listed on this website are for references only. IN SOME INSTANCES, Pictures on the site IS NOT THE IMAGE OF THE ACTUAL PART THAT YOU WOULD BE PURCHASING.
Department of Transportation’s Law & Motor Vehicle Act
- All modifications, except those that are exempt, have been designed and are intended for off-road use only which may never be used on city streets or highways.
- Federal and many provincial laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways.
- Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle.
- It is the User/Buyer’s responsibility to know their local City and State / Provincial Laws.
Abandoned Parts
- All parts left at AutoFX will be considered abandoned after 14 days.
- Abandoned parts become the property of AutoFX.
Shipping
- The customer is responsible for all fees including but not limited to: duty, import taxes, and brokerage fees that may be applied in shipping.
- Auto FX is not responsible for items lost or damaged in shipping.
Pricing & Payments
- Payment is due in full once all services have been rendered or products ordered in have been received and are ready for pickup.
- Should the amount due not be paid, Auto FX reserves the right to withhold vehicles and products until the balance due is paid in full.
- Impounded vehicles are subject to storage fees to be determined by AutoFX.
- Interest will be charged if payment is made after a set deadline.
- Should the balance due not be paid within 14 days, Auto FX has the right to take the required steps in order to resolve the situation. This can include, but not limited to, removing installed parts, selling ordered items, selling vehicles, legal action, impounding, and collections.
- All orders paid with PayPal are only available to verified accounts and are subject to a handling fee.
- Pricing can change at anytime without notice.
Estimates
- All estimates (product & labour) are valid only for the day they are given.
- Prices are subject to change without notice.
Products
General
- All products sold at Auto FX are considered for off-road use only and are provided as “use at your own risk”. Auto FX shall NOT be liable for any damages, maintainence, fees or associated costs direct, indirect, incidental, or consequential from the use of any products sold.
Warranty
- All merchandise (excluding bodykits/aerodynamics and used items) sold by Auto FX are only subject to the manufacturer’s warranty and conditions, if any, and is subject to submission to the manufacturer for inspection and approval for repair, or replacement of merchandise. Customer will also be responsible for all shipping costs incurred to fulfill warranty.
- There is NO warranty on USED merchandise. These items are sold as is unless otherwise noted.
- No warranty whatsoever will be valid if the defect was caused by customer’s abuse, negligence, or mishandling.
- No warranty will be valid on items that were not installed by Auto FX or by another qualified shop.
- No labor or inconvenience claim may be included in the warranty claims.
- Auto FX highly recommends that you always keep your stock parts for as long as you have your vehicle. Therefore, Auto FX is not responsible if your car is inoperable due to sending us the part for warranty claim.
Returns & Exchanges
- No Returns – All sales are final.
- Limited exchange within 14 days with original receipt only.
Out Of Stock, Order Items & Special Order Items
- All order items require 100% deposit (after taxes).
- All deposits are non-refundable and orders cannot be cancelled. A deposit refund will be issued if the item(s) on order can no longer be provided by it’s manufacturer or supplier.
- Please allow 1-2 weeks* for ordered items to arrive.
* This time may vary depending on shipping methods, back orders, availability and unforeseen incidents. Auto FX is NOT responsible for shipping delays, errors, back orders, or anything beyond our control. 1-2 weeks represents a best case scenario.
Used Engines
- All used engines carry a start-up warranty. This warranty does not cover running condition or fitness of the engine.
- There are no warranties either expressed or implied on the transmission or any other attached components on the engine long block.
- Start-up warranty is only valid if the following items are changed prior to start-up: Spark plugs, spark plug wires, distributor cap & rotor, timing belt and associated components, and water pump. Also it is required that the motor be checked for proper timing prior to and during the initial start-up.
- Please remember, you are purchasing a USED motor. We at AutoFX try our best to supply quality used engines, but unfortunately these motors may need rebuilding. We HIGHLY recommend that engines bought be fully rebuilt to insure reliability and performance.
Services
General
- Shop Labor Rates: $75/hr (general), $90/hr (fabrication, electronics, tuning).
- All shop labor carries an additional 5% shop material fee.
- You authorize AutoFX to perform the requested services as well as use any parts and materials necessary (within reason and common sense) in order to fulfill the request.
- You authorize AutoFX and it’s employees to operate your vehicle on any street, road, or highway for the purpose of testing.
- AutoFX does not assume responsibility for vehicles or items left in them when delivered to Auto FX for service.
- Some services (including installation of certain products) require the vehicle to be placed on an intensive maintenance schedule in order to ensure reliability and safety. It is the sole responsibility of the customer to understand this and to perform the required additional maintenance which can include (but not limited to) oil changes, adjustments, and safety inspections.
- No inconvenience claims can be made while services are being performed on vehicles.
Warranty
- All labor performed at AutoFX carries a one year (or 12,000km; whichever comes first) limited warranty from date of service against defects in workmanship under normal road conditions. Vehicles used in any form of racing shall be exempt from this warranty unless otherwise noted.
- Warranty Exclusions: Original service(s) performed have be altered or modified, misuse, abuse, improper care and maintenance, vehicle has changed ownership, customer supplied parts that are deemed unfit for use.
Damages
- Auto FX is not responsible for any damage to items (or obstructions) that are required to be removed (or otherwise altered) in order to perform the requested service (ie integrated trunk stereos, custom panels, etc). Auto FX recommends that any obstruction(s) be removed from the vehicle prior to the services being performed.
- Auto FX does not assume responsibility for prior damages on vehicles. Piror damages will be documented before any services are performed.
- In the unlikely event of damage to your vehicle during service at Auto FX, it is your sole responsibility to claim the damages at time of pickup. Once the vehicle leaves the premises, no damage claims can be made against Auto FX.
Packaged Installs
- Certain items sold by Auto FX are packaged with free installation (no labor charges).
- Auto FX reserves the right to charge an installation fee should any of the following conditions arise in order to complete the installation: rusted and seized parts are required to be removed, modification of components required, damaged or broken components.
- Auto FX reserves the right to remove the offer of free installation at any time, for any reason.
- Packaged installs do not include the shop material fee, or other items needed for installation (ie gaskets, screws, fuses, wire, etc).
Aerodynamic, Bodykits, Carbon Fiber & Spoilers
Warranty/Liability
All body kits/ aerodynamics (product) sold by Auto FX (TGR GarageWorks LTD.) are sold “as is” to the customer. Auto FX does NOT offer any warranty, expressed or implied, including any warranty of merchantability or fitness for a particular purpose on any of the products sold. If warranty is offered by the manufacturer, warranty documentation will be sent with the product. All products sold by Auto FX are aftermarket products and are intended for off-road or show use only. Auto FX is not liable for any damages or injury as a result of these products. Due to strict regulations by the Department of Transportation & Motor Vehicle Act, some of these products are not approved for street/highway use. Removal of reinforcements, bumpers, turn signals, and other safety equipment on the vehicle is the sole responsibility of the buyer. It is the purchaser’s responsibility to comply with applicable laws. Auto FX will not be responsible for the customer’s actions. Customer is responsible for the shipping costs for shipping a body kit back to the manufacturer and for shipping from the manufacturer back to the customer, should a manufacturer warranty be offered.
Installation of Aerodynamics
All aerodynamics are manufactured with fiberglass unless otherwise noted. Due to the material used in production, the body kits will NOT be a direct bolt-on. These body kits may require prepping, sanding, shaving, filling gaps, cutting, or other extensive body work. These modifications may include removal or cutting of the reinforcement bars. By complying with our policies, customer understands the procedure and possible difficulty in installing the body kit. We HIGHLY recommend that a professional body shop with custom fiberglass and carbon fiber experience perform the installation. Regular collision shops should never be used. Refunds will not be issued due to poor fitment of the body kit. Auto FX is not responsible for the costs incurred to fit a body kit as well as any inconvenience claims.
Shipping Damage
Body Kits / Aerodynamics will not be refunded due to shipping damage unless the kit is beyond repair. A kit is considered beyond repair if it had been completely shattered or broken into a minimum of six pieces.
Terms of Sale
All body kit / aerodynamic sales are final. Body kit/aerodynamics are considered special order and require a 100% deposit before the order is processed. There are NO returns or exchanges.
Auto FX reserves the right to modify the terms and conditions above at any time for the purpose of clarification.
